Working Time

According to applicable regulations, the working time of a person with a disability cannot exceed 8 hours per day and 40 hours per week. However, individuals with significant or moderate disabilities may work a maximum of 7 hours per day and 35 hours per week. Persons with disabilities cannot be employed during the night shift or overtime.

The shorter working hours for individuals with significant or moderate disabilities do not reduce their salary. An individual who received a fixed monthly salary and presented a certificate of significant or moderate disability is entitled to receive the same salary. However, for employees transitioning to a shorter working schedule, whose salary is determined by an hourly rate (based on their personal classification or job classification), the hourly rate must be appropriately increased (in proportion to the previous working hours to the shortened working hours).

Important:

The aforementioned working hour restrictions do not apply:

to individuals employed in surveillance or if the employee agrees, upon request, a doctor conducting the employee’s preventive examination, or, in their absence, the doctor providing care for the individual.
