Employee Rights
Additional employee rights for people with disabilities are regulated in Chapter 4 of the Act of August 27, 1997, on Vocational and Social Rehabilitation and Employment of Disabled Persons, as well as in the implementing regulations to this Act.
Employee rights apply to a person with a disability from the day they are included in the employment of disabled persons at a given employer. A person with a disability is included in the employment of disabled persons starting from the day they present the employer with a certificate confirming their disability (if it is the first certificate presented to the employer).
When the employer receives another certificate confirming the disability, the person is included in the employment of disabled persons from the day the application for the certificate was submitted (if the certificate indicates that the person was disabled during that period and the application was submitted no later than the day after the expiration of the previous certificate confirming disability). However, if the application for the subsequent certificate was submitted after the expiration of the previous certificate, the person with a disability is included in the employment record for up to 3 months prior to the day the employer receives the next certificate, provided the certificate confirms the person was disabled during that period.
